Terms of Service — Notefoot
Effective November 2026
Welcome to Notefoot. Notefoot is a social app for leaving voice notes, photos, and short clips at real places, and for finding the notes other people have left. By creating an account or using Notefoot, you agree to these terms. If you do not agree, do not use the service.
1. Who runs Notefoot
Notefoot is operated by the Notefoot operator ("we", "us", "Notefoot"). Questions about these terms can be sent to hello@notefoot.com.
2. Your account
- Accounts are created with a username and password. There is no email sign-up.
- You may set an optional 12-word recovery phrase. We store only a salted cryptographic hash of that phrase. We cannot see it, read it, or recover it for you. If you lose both your password and your recovery phrase, your account cannot be recovered. That is a real limit of how the service is built, not a policy choice.
- You are responsible for everything that happens on your account. Keep your password and recovery phrase private. Do not share your account.
- You must be at least 13 years old to use Notefoot. The service is not directed at children under 13, and accounts found to belong to someone under 13 will be removed.
- One person may hold more than one account (for example a personal and a public identity), but no account may be used to break these terms, evade a ban, or impersonate someone else.
- Usernames are first come, first served. We may reclaim a username that impersonates a person or business, is used for squatting or extortion, or is tied to an account removed for breaking these terms.
3. Your content
"Your content" means the voice notes, photos, clips, captions, comments, messages, and other material you post or send through Notefoot.
- Your content belongs to you. Posting it does not transfer ownership to us.
- To run the service, you give us a worldwide, non-exclusive, royalty-free license to store, copy, process, transcode, display, distribute, and transmit your content as needed to operate Notefoot: for example, showing your posts to the audience you chose, delivering your messages and calls, generating playback, and creating backups. This license ends when the content is deleted from our systems, except for copies already shared by other users (for example a message in someone else's inbox) and copies retained for a limited time in backups as described in the Privacy Policy.
- You choose an audience for your posts where the app offers that choice (everyone, only you, or named people). We enforce the audience you set on our read paths. Content set to a wider audience can be seen, saved, or reshared by anyone who can access it. Do not post anything as public or shared that you need to keep private.
- You promise that you have the rights to post your content and that it does not violate anyone else's rights or any law.
- We do not claim ownership of your content and we are not responsible for what users post. See section 8 for reporting and removal.
4. Places and sealed notes
- Notes can be pinned to the place where you post them ("dropped here"). A dropped note's location is part of the post and is visible to its audience.
- A "sealed" note unlocks only when a viewer's device reports it is within about 100 feet (30 metres) of where the note was dropped. Unlocking uses consumer GPS, which is approximate. See the Liability & Safety page for the limits of this feature. Sealing is a playful access control, not a security guarantee: do not seal anything whose disclosure would cause real harm.
- You are responsible for where you go and what you do to reach a note. See the Liability & Safety page.
5. Messages and calls
- Direct messages and group chats are delivered between the accounts involved. Messages are visible to the participants of the conversation. We may access message content when required to operate the service, respond to a report, or comply with the law.
- Voice and video calls run over WebRTC. Media may pass through relay servers (TURN) when a direct connection is not possible; relayed media is encrypted in transit and is not recorded by us. Calls are not recorded by Notefoot unless a participant uses their own device to record, which we cannot prevent or detect.
- Do not record or share a call or private message outside its audience without the consent of the people involved, where consent is required by law.
6. Acceptable use
You may not use Notefoot to:
- Break the law, or help anyone else break the law.
- Post or send content that is illegal, threatening, harassing, hateful toward a protected group, sexually exploitative, or that sexualises minors in any way. Content involving the sexual exploitation of minors results in immediate account termination and a report to the appropriate authorities.
- Impersonate another person or business, or mislead people about who you are.
- Post someone else's private information (addresses, phone numbers, documents, exact real-time location) without their consent.
- Stalk, track, or facilitate harm to any person, including by using dropped or sealed notes to lure someone to a place.
- Spam, run fake or automated engagement, create accounts in bulk by automated means, or sell or buy accounts, usernames, likes, or followers.
- Probe, scrape, overload, or interfere with the service or its infrastructure, or attempt to access accounts or data that are not yours.
- Upload malware or content designed to harm devices.
- Infringe copyright, trademark, or other rights. See section 9 for the copyright notice route.
We may remove content and warn, restrict, suspend, or permanently terminate accounts that break these rules, at our discretion, with or without notice. We may also act on content or accounts where we reasonably believe there is a risk of real-world harm or a legal obligation to act.
7. Reporting
You can report content and accounts in the app, or by writing to hello@notefoot.com. We review reports and act as described above. Reporting does not guarantee a specific outcome; we will tell you what we can about the result where it is sensible to do so.
8. Moderation limits
Notefoot is a small service. We do not pre-screen user content, and we cannot guarantee that content breaking these terms will be found or removed within any particular time, or at all. You may encounter content you find offensive. Your remedies are the report tools, blocking, and your right to stop using the service. Nothing in this section limits any obligation we have under applicable law.
9. Copyright (DMCA)
If you believe content on Notefoot infringes your copyright, send a notice to hello@notefoot.com with: your name and contact details, identification of the copyrighted work, the location of the infringing content on Notefoot (a link or enough detail to find it), a statement that you have a good-faith belief the use is not authorised, and a statement, under penalty of perjury, that the information is accurate and you are authorised to act. We will act on valid notices, which may include removing the content. Repeat infringers' accounts will be terminated. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address with your details, the removed content, and your consent to the jurisdiction required by law.
10. The service is provided "as is"
- Notefoot is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability, to the maximum extent permitted by law.
- Features may change, break, or be withdrawn. Data may be lost despite reasonable backups. Keep your own copies of anything that matters to you.
- Location features depend on your device's GPS and on third-party map and network services. Locations shown may be inaccurate, delayed, or unavailable.
11. Limits on our liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or reputational harm, arising from your use of Notefoot.
- Our total liability for any claim arising from the service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
- We are not liable for the actions of users, for user content, for anything that happens at a real-world place connected with a note, or for meetings or encounters arranged through the service. The Liability & Safety page describes these risks; using Notefoot means you accept them.
- Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence where the law does not allow exclusion.
12. Indemnity
You agree to indemnify and hold harmless the Notefoot operator, and anyone working on Notefoot, from claims, damages, and reasonable legal costs arising from your content, your use of the service, or your breach of these terms, to the extent permitted by law.
13. Ending your account
- You may delete your account at any time. The Privacy Policy describes what is deleted and what is retained, and for how long.
- We may suspend or terminate your account for breaking these terms, for legal reasons, or if the service shuts down. Where it is reasonable, we will tell you why.
- If the service shuts down permanently, we will give reasonable notice where we can. Content and accounts may not be exportable after shutdown.
14. Changes to these terms
We may update these terms. The current version will be posted at notefoot.com/terms with its effective date. Material changes will be surfaced in the app. Continuing to use Notefoot after a change takes effect means you accept the updated terms.
15. Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except where the law of your place of residence gives you protections that cannot be waived. Disputes will be resolved in the state or federal courts located in California, unless applicable law gives you the right to bring a claim in your local courts. If any part of these terms is found unenforceable, the rest still applies.
